Terms of Service

These Terms of Service ("Terms") govern your use of incosicare.com and the Cosi Care skin symptom tracking application (the "Service") operated by Cosi Care Ltd ("the Company," "we," "us," or "our") (Baltic Place, 50 Quayside, Newcastle upon Tyne, NE1 3JE, United Kingdom). By creating an account or using the Service you accept these Terms.
Nothing in these Terms limits your statutory rights as a consumer under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or other applicable UK consumer-protection law.
1. Agreement
These Terms constitute a legally binding agreement between you and the Company. If you do not agree to these Terms, please do not use the Service. The Company may update these Terms from time to time; material changes will be notified by email and posted with an updated "Last updated" date.
2. Use of the Service
- You must be at least 18 years old to create an account. Parents or guardians may create accounts on behalf of children under 18 to track that child's skin symptoms, taking responsibility for appropriate use.
- You agree not to use the Service unlawfully, to interfere with its operation, or to attempt unauthorised access to accounts, systems, or networks connected to the Service.
- You may not copy, scrape, or reverse-engineer the Service except as expressly permitted by applicable law.
- The Service is a personal symptom tracking and care-prompting tool. It does not provide medical diagnoses, clinical assessments, or prescription advice. Always consult a qualified healthcare professional for medical decisions about your skin condition.
3. Intellectual Property
The Service, including all software, design, text, and pattern-analysis features, is owned by the Company or its licensors and is protected by UK and international intellectual-property law. You receive a limited, non-exclusive, non-transferable licence to use the Service for its intended personal tracking purpose. Nothing in these Terms transfers ownership of any intellectual property to you.
4. User Content
You are responsible for the accuracy and appropriateness of any content you submit to the Service, including symptom diary entries and skin photographs. You grant the Company a limited licence to store, process, and display that content solely to provide the Service to you. We do not use your health diary entries or photographs to train machine-learning models without your separate, explicit written consent.
You retain ownership of your personal data. You may export or delete your data at any time through your account settings. On account deletion, all health diary entries and photographs are removed within 30 days.
5. Right to Cancel (Consumer Contracts Regulations 2013)
Where you enter into a paid distance contract with the Company as a consumer, you have a 14-day right to cancel from the date of purchase under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To exercise this right, email [email protected] with a clear cancellation statement. We will process any applicable refund within 14 days.
6. Disclaimers and Statutory Rights
The Service is provided "as is" and is intended as a personal wellness and tracking aid. The Company makes no warranty that the Service will identify your triggers, prevent flares, or constitute a substitute for professional dermatological or medical care.
Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by the Company's negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded under the laws of England and Wales. Your statutory consumer rights, including those under the Consumer Rights Act 2015 regarding reasonable care and skill, are not affected.
7. Limitation of Liability
To the extent permitted by law, the Company's total liability for any claim arising from or related to the Service will not exceed the greater of (a) the amounts you paid to the Company in the 12 months before the claim arose, or (b) GBP 100. This limitation does not apply to the exclusions set out in Section 6.
8. Termination
You may close your account at any time through account settings. The Company may suspend or terminate access if you breach these Terms, with notice where reasonably practicable. Provisions that by their nature should survive termination - including intellectual property, limitation of liability, and governing law - will continue to apply.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
The courts of Newcastle upon Tyne, United Kingdom have exclusive jurisdiction over any dispute arising from these Terms or your use of the Service, subject to your right as a consumer to bring proceedings before the courts of your place of residence in the United Kingdom.
10. Changes
We may update these Terms. Material changes will be communicated by email to registered users at least 14 days before they take effect. Continued use of the Service after the effective date of an update constitutes acceptance.
